These Terms & Services (“Terms”) govern your access to the website located at rarebeercans.com (the “Site”), operated by HomeShield Warranty (“HomeShield,” “we,” “us,” or “our”), and your purchase or use of any home warranty service contract (“Plan” or “Contract”) offered through the Site or through authorized sales partners. By visiting the Site, submitting a form, or enrolling in a Plan, you agree to these Terms. If you do not agree, do not use the Site or enroll in coverage.
“Member” means the person or entity named as the contract holder on an active Plan.
“Covered Item” means a system or appliance specifically listed as covered in the Member’s Plan documents.
“Service Request” or “Claim” means a request for repair or replacement of a Covered Item due to a breakdown during normal residential use.
“Trade Call Fee” means the per-visit service fee stated in your Plan, payable to the contractor at the time of service unless otherwise specified.
“Breakdown” means the failure of a Covered Item to function primarily because of a mechanical or electrical defect arising from normal wear and tear, as determined by us or our authorized contractor.
A home warranty is a service contract, not homeowner’s insurance, flood insurance, or a builder’s structural warranty. Plans cover qualifying repairs and replacements of specified items subject to exclusions, limits, and conditions in your Contract. HomeShield does not guarantee that every mechanical failure will be covered. Coverage applies only after any applicable waiting period and only for Covered Items in good working order on the contract effective date, except as otherwise stated in writing.
You are responsible for maintaining your property, including routine maintenance such as changing HVAC filters, clearing drains, and following manufacturer guidelines. Failure to perform reasonable maintenance may result in denial of a Claim if the breakdown is attributable to neglect.
When you request a quote or enroll online, you provide information about your home and desired coverage. An offer to purchase becomes binding when we accept your enrollment and payment (or your authorized partner confirms enrollment) and issue a Contract confirmation. The Contract confirmation, Plan summary, and state-specific addenda, if any, together form the entire agreement regarding coverage and supersede conflicting statements on marketing pages unless explicitly incorporated by reference.
You represent that all information supplied during enrollment is accurate. Material misrepresentation may void coverage or result in cancellation. For properties used partially for commercial purposes, coverage may be limited or unavailable; contact us before enrolling.
Unless your Plan states otherwise, a waiting period applies from the Contract effective date during which certain Claims may not be eligible. Items that were malfunctioning, inoperative, or under prior repair before the effective date are generally excluded as pre-existing conditions. Our contractors may document equipment condition during the first service visit; photographic and diagnostic evidence may be retained in your account.
Claims must be filed through the Member portal, email to claims@rarebeercans.com, or other channels we designate. When filing, describe symptoms accurately and provide access to the Covered Item. We will assign an independent contractor from our network when available in your area. If no contractor is available, we may authorize reimbursement for reasonable out-of-network service up to our usual and customary limits, at our discretion.
You must be present or arrange adult access for scheduled appointments. Missed appointments may incur a re-dispatch fee. Emergency service for loss of heat or cooling may be prioritized based on local regulations, weather conditions, and technician availability; we do not guarantee same-day service in all locations.
We authorize repair when economically feasible. When repair is not feasible or exceeds item limits, we may offer replacement with a model of similar capacity and features, subject to depreciated value calculations stated in your Contract. Aggregate annual limits, per-item caps, and code-upgrade exclusions apply as written. Cosmetic defects, rust, sediment buildup, and manufacturer recalls are generally excluded unless expressly covered.
Contractors perform work as our agents for the limited purpose of diagnosis and repair. You agree to release HomeShield from liability for contractor negligence beyond amounts required by applicable law, and to direct workmanship concerns to us for resolution through our quality assurance process.
Plan premiums may be billed monthly or annually as selected. Trade Call Fees are separate from premiums and are due per visit unless your Plan includes waived fees. Late payments may result in suspension of Claim eligibility until the account is current. Plans renew automatically for successive terms at then-current rates unless you cancel in accordance with Section 8. We will provide renewal notices where required by law.
Price changes apply to renewal terms, not mid-term unless you change Plans or add optional coverage. Promotional discounts may expire at renewal.
You may cancel within any applicable free-look period for a pro-rata refund of unused premium, minus Claims paid or authorized. After the free-look period, cancellation terms follow your Contract and applicable regulations. Upon sale of the home, Plans may be transferable to a buyer if requested within the stated timeframe and if the buyer accepts remaining terms. HomeShield may cancel for non-payment, fraud, or unsafe conditions at the property.
Your Contract contains the authoritative exclusion list. Common exclusions include, without limitation: structural components, foundation, pest damage, mold remediation, cosmetic items, portable appliances, items under manufacturer warranty, improper installation, code violations existing before enrollment, acts of nature, war, terrorism, and damage from frozen pipes when heat was not maintained. This summary does not expand or limit written exclusions.
Content on the Site—including text, graphics, logos, and software—is owned by HomeShield or licensors and protected by copyright and trademark laws. You may view and print pages for personal, non-commercial use. You may not scrape, mirror, or use the Site to compete with our services without written permission.
We strive for accurate Plan descriptions but marketing content is illustrative. Always rely on your issued Contract for binding coverage terms.
By submitting forms or enrolling, you consent to receive communications electronically, including email notices about Claims, billing, and policy updates. You are responsible for keeping your email address current in your account profile.
THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SITE. COVERAGE UNDER A PLAN IS GOVERNED SOLELY BY THE CONTRACT, NOT BY SITE CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESHIELD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM SITE USE OR COVERAGE DISPUTES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID FOR THE PLAN IN THE TWELVE MONTHS PRECEDING THE EVENT, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold harmless HomeShield from claims arising out of your misuse of the Site, violation of these Terms, or misrepresentation during enrollment, except to the extent caused by our gross negligence or willful misconduct.
Before initiating formal proceedings, you agree to contact us at hello@rarebeercans.com and allow thirty (30) days to resolve the dispute informally. If unresolved, disputes shall be resolved through binding arbitration on an individual basis, except that either party may seek injunctive relief in court for intellectual property misuse. Class actions and class arbitrations are waived to the extent permitted by law. The arbitrator shall apply the substantive law of the state indicated in your Contract without regard to conflict-of-law rules.
These Terms and Site use are governed by the laws of the state specified in your Plan documents, without regard to its conflict of law principles. If no state is specified, the laws of the state where HomeShield is organized shall apply.
We may update these Terms by posting a revised version on the Site with a new effective date. Material changes to active Plans will be communicated as required by your Contract or applicable law. Continued Site use after changes constitutes acceptance of updated Terms for Site use; Plan changes apply only as permitted in your Contract.
If any provision of these Terms is held invalid, the remaining provisions remain in effect. For Plan coverage, the Contract is the entire agreement between you and HomeShield regarding warranty services. These Terms supplement the Contract regarding Site use and enrollment processes.
